TERMS OF OUR INTRODUCTIONS TO OUR APPLICANTS
It is important that, as an applicant (you) to Rutherfords Ltd. (our, we or us) , you note these terms as to our role in providing information on properties to you, and placing you in contact with vendors, owners or their agents, in the Caribbean.
- OUR ROLE AND STATUS. Rutherfords Ltd. is a company based in the United Kingdom, acting as agents for our principals throughout the Caribbean who are vendors, owners or Caribbean-based real estate agents (principals) seeking to sell or let property or developments (property or properties). We do not act as agents or in any other legal capacity for our applicants, unless otherwise agreed with you in writing, so you are not liable to us for any fees or other payments, which we receive from our principals.
- REGISTRATION WITH US. When you first contact us requesting information and/or particulars regarding properties, we will ask you to provide us with your contact details and property requirements. You accept that we may need to pass all or some of such registration details to our principals. It would help if you provide us with as much detail as possible regarding any specific requirements, and you should advise us in writing should your requirements change, or you no longer wish to remain registered with us.
- PARTICULARS & DISCLAIMER. Following registration, we will assess your requirements and commence identifying potential properties for your consideration, either from our database of properties available or through contacts with our principals. Note that property details supplied to you will be those supplied to us by our principals, unless we confirm otherwise in writing. Property information provided by us to you is done so in good faith, but with no warranties expressed or implied relating to the accuracy of the same, and we shall not be liable to you for any costs incurred by you in relation to any property or potential transaction.
- ADVICE & ASSISTANCE TO YOU. We understand that you may ask us for advice and assistance in your consideration of possible property options and we will endeavour to assist in good faith at all times. However, as with any potential property transaction, we recommend that you appoint a local property advisor/ lawyer to advise you in relation to any specific property, whose fees will be your responsibility.
- NO PAYMENTS OR DEPOSITS HELD. We will not accept any payments or deposits from you in relation to any property, nor are our directors, employees or other representatives permitted to do so, which you will be required to make locally in respect of any proposed transaction. We recommend that any such payment is made via your legal representative.
- JURISDICTION. Any property transaction or intended transaction entered into by you will be subject to the local law and within the jurisdiction of the appropriate local court of the Caribbean island or area. Any question or dispute arising out of our introduction to you of property or properties, or particulars thereof, shall be subject to English law and to the exclusive jurisdiction of the English courts.
